Kolkata: The meeting on Friday was chaired by the Speaker of Bangladesh Parliament, Biman Banerjee and the newly elected provincial councilors Sayantika Banerjee and Reyat Hossain Sarkar were sworn in.. In response, Governor C.V. Ananda Bose promptly wrote to President Droupadi Murmu alleging “unconsitutionality”. But speaker Banerjee has said that he didn’t act outside his powers.
In line with Article 188 of the Constitution, Deputy Speaker Asish Banerjee was allowed to be sworn twice as an MLA by Bose.
The Business Advisory Committee decided on Friday morning that the Speaker will these oaths of office during a special sitting of the House. When it started at 2 pm, yesterday’s session commenced with a letter from Governor’s office. Which reached the speaker’s chamber at 9.22 pm which had instructed Mr. Bose to have his deputy administer this oath.
However, this action did not happen because Deputy Speaker Asish Banerjee refused to comply with this order. “The Speaker is in the House. I cannot ignore the norms (and take the oath) in his presence. It would be disrespectful and insulting to the Chairman,” he said. He urged the Speaker to take oath and who takes an oath immediately after him.
Sobhandeb Chattopadhyay, State Parliamentary Affairs Minister disclosed that Chapter 2. Rule 5 of Rules and Procedures for Conducting Business in Parliament stipulates that “a member who has not taken oath under Rule 188 may take it when the House is sitting” or at any other time. When it is within session provided.” ‘Follow instructions’ given by the Speaker,” Chattopadhyay insisted no law was broken.
However, governor objected this by saying that according to section 188 a member shall take his oaths before Governor or any person appointed by him’. Consequently, Bose argued: ‘The Governor has violated the constitution by appointing two Deputy Speakers. Even if he had not established himself as such, this action was realized.
