In relation to the arrest of Arvind Kejriwal, close aide and former Delhi Chief Minister, by American AP Association Congressman Swati Maliwal, on suspicion of assaulting him, on Friday the Delhi High Court dismissed Bibhav Kumar.
Kumar’s lawyers argued that he was illegally arrested citing delayed registration of FIR. They claimed that he had willingly contacted the police on May 18 for investigation purposes and then got arrested on the same day.
The request was rejected by stating that Kumar’s arrest was not rushed but justified.
After hearing arguments from both sides on July 8, the court reserved its judgment in Kumar’s petition over his bail.
Bibhav Kumar is facing charges of attacking Maliwal at Chief Minister Kejriwal’s official residence on May 13 while in judicial custody.
On May 16 an FIR was filed against Kumar for criminal intimidation under Indian Penal Code (IPC), destruction of evidence, assault or use of criminal force against a woman with intent to outrage her modesty and attempt to murder.
Bibhav Kumar has been denied bail twice earlier by both trial court and High Court; his appeal is now pending before Supreme Court.
