No reception at the Supreme Court on Friday, pleads 2 out of 11 accused. Bilkis Bano’s case, which has been pending since January 8, seeks to challenge the cancellation of their ease through a plea before Justice Sanjiv Khanna and Sanjay Kumar.
“What is this defence? How can one establish this defense? This is completely wrong. Article 32 Petition filed? We cannot appeal against another judge’s order,” the bench said.
Lawyer Rishi Malhotra who represented the convicts Radhey shaym Bhagwandas Shah and Rajubhai Babulal Soni sought permission to recall their guilty pleas.
The lawyer was permitted by bench for discharge his plea .
Shah also applied for interim bail.
March witnessed two prisoners filing an appeal before SC contending that cancellation of reduced sentences on Jan 8 was “in consonance” with Constitutional Bench Order of 2002 and requesting that it be referred to a larger bench for “final” disposal.
