School resource officer Tracy Hall testified that the relationship between Bergman and the victim escalated significantly early in the year.
Hall detailed explicit communications in which Bergman admitted to physical interactions with the boy, including conversations about feeling aroused when hugged and one in which she chose to wear a dress because she liked the way he touched her.
Defense attorney Joseph Tamburino countered that the text messages did not clearly indicate a desire for sex, arguing that they lacked direct language such as “I want to have sex with you.”
“They talked a lot about kissing, lips, cheeks and leg touching,” Tamburino continued.
“They also talk about some sexual issues, obviously about women’s bodies and men’s bodies. But it’s never ‘this is what I want you to do to me’ or ‘this is what I’m going to do to you’.
However, the judge ruled that the evidence presented was sufficient to establish probable cause for the charges.
The allegations came to light when the victim’s mother overheard him talking to Bergman on the phone and later discovered inappropriate text messages on his device.
Their interactions included several encounters in Bergman’s classroom during lunch or after school, according to the investigation.
When police searched Bergman’s classroom, they reportedly found a folder labeled with the victim’s name in her bag. The folder allegedly contained handwritten notes detailing their intimate encounters, including kisses and caresses.
Bergman resigned from his position at River Crest Elementary School shortly after the allegations came to light in May.
Bergman made headlines in May when she was accused of “making out” with a fifth-grader weeks before her wedding.
She has pleaded not guilty to all charges and is scheduled to undergo further court proceedings if the case goes to trial.
If convicted, she could face serious jail time for her actions.
