The Congress boss will hold Meeting What we are to discuss today is Strategy and take a position on the issue raised subsequent to the Supreme Court’s decision cream layer Members of castes/scheduled tribes shall be excluded from reservation.

The meeting will take place at Congress President Mallikarjun Haq’s residence by 6:30 p.m.

Apart from Haq, LoP Lok Sabha Rahul Gandhi, Congress MPs KC Venugopal, Jairam Ramesh and other senior leaders will also be present.

In an epic decision on August 1st, the SC stated that states have the legislative capacity to divide SCs and STs on the basis of validity not adequacy represented. Quantification criteria for adequacy representations.

By six votes against one, the Supreme Court ruled in favor of sub-division within reservations for SCs and STs. There were as many as six different opinions on the case.

Delivered by a seven-judge bench headed by Chief Justice Of India DY Chandrachud, this ruling reversed its own earlier verdict in EV Chinnaiah v State Of Andhra Pradesh And Anr which said that segmentation was not allowed as Scheduled Castes/Scheduled Tribes formed a homogeneous category.

Asides CJI Chandrachud, the other judges presiding over it included BR Gavai, Vikram Nath, Bela M Trivedi, Pankaj Mithal and Manoj Misra, Satish Chandra Sharma

Justice B R Gavai recommended that there should be a state policy aimed at identifying those belonging to creamy layer including even scheduled castes and scheduled tribes so that they are left out from affirmative actions’ benefits.

On her part justice Bela M. Trivedi in her dissent said she did not agree with majority’s opinion that there could be subdivisions within scheduled castes and scheduled tribes.

Union Minister Chirag Paswan disagreed with this view expressed by the also Supreme Court and announced that BJP (Ram Vilas) would be filing for a review petition.

Bharatiya Janata Party MP Manoj Jha also said that he respects the decision but this breakdown reflects injustice, is senseless and is emotionless.
