Mumbai: Bombay high court A medical committee report has been sought from Jinjiang Hospital A 12 year old girl who was raped by her 14 year old brother has asked for medical help to stop her more than six month pregnancy.
On Thursday, a bench of Justices Revati Mohite Dere and Manjusha Deshpande ordered the formation of a medical committee to examine her with the directive that the report would be submitted to the vacation bench on Monday.
The writ petition was filed by advocate Ashley Cusher, who said that on May 2nd, her daughter complained about stomach pains. At a health center, doctors suspected pregnancy and conducted tests to confirm this. From October, she narrated how my brother used to sleep with me against my will whenever our parents and everybody else were gone.
He threatens her with dire consequences. An FIR was lodged against the boy under IPC and POCSO Act based on mother’s complaint made at same day and he was sent to juvenile home. On 3 May, the girl was brought before Child Welfare Committee in Palghar district and admitted into Shelter Home. Further investigations carried out at JJ Hospital revealed that she is “24 weeks and 5 days pregnant.”
Her mother’s petition stated that according to doctors she could experience premature labor, low birth weight infants, respiratory distress syndrome, electrolyte imbalance as well as kidney disease. In cases where fetal growth is detected in minors’ uterus there may be serious complications implicating both lives involved. Even so going through normal delivery up until term poses physical harm to the child besides mental stress besides exposing risk to her life…” “Twelve or thirteen years are too young for child bearing… underage girls have right of getting education and employment but because of this pregnancy minor/victim cannot even get education,” reads this petition.
“My wish is that she can live an ordinary life without any deformities or diseases,” said the mother.
According to her petition: “… with the changing conditions of the petitioner’s daughter and the fetus she is carrying, there is always an effect on the condition of a fetus in uterowhich affects … children as well as the petitioner’s daughter.
