At New Delhi, Monday the Supreme Court of India criticized the state government for not correcting any flaw in its pleads to Haryana over releasing balance water from himachal pradesh toward Solving water crisis in Delhi.
As per Vacation Bench consisting of Justice Prashant Kumar Mishra and Justice Prasanna B Varale which stressed that the Registry would not be able to accept the affidavit as there were defects in it.
“Why didn’t you cure these defects? We shall dismiss this petition. This was also pointed out on the last date but no corrective steps were taken by you. So even if your case is very important. Don’t take court for granted,” said the bench.
Justices added that court process must be treat seriously and warned that they could throw out defence unless there were improvements made.
“We will never be take for granted. The filing is not receive. You filed a number of affidavits directly in the court and then today. You are saying;you have a scarcity of water.” During all this period when all hoary hasty grounds have been raised. Sex matter has been slowly letting all get recorded down.
The Supreme Court said it wants to review all documents before hearing this case especially because “Updates have occurred within so many news stories” (23).
“If we do not read such documents at field office level, we will only go by newspaper reports. There will be no advantage either side”. The judges noted.
Starting off with Shyam Dewan’s submission of his client’s response among others, learned senior advocate appearing for Haryana opposed regarding timing of such filing by itself.
Dewan said that registry had refused to accept pre-filed reply because Delhi’s defense was defective.
This made Supreme Court condemn again the State Government of Delhi while noting that Derry’s lawyer claimed that it had cured those defects.
Before now, Existential issue was recognize by Supreme Court about acute drinking water shortage in Delhi. In particular, the court directed Himachal Pradesh government to release 137 cubic feet of excess river water to New Delhi as Haryana ensured that such flow was smooth.
The Apex Court emphasized that politicizing water issues is not correct. According to it, Himachal Pradesh can add more water today because they are readily available.
“Since there is no objection from Himachal Pradesh for releasing its available surplus water and it is ready and willing to do so. We hereby direct that HP should release its available surplus water of 137 cusecs from upstream so that the same reaches Hathnikund barrage through Wazirabad,”. The bench had said at an earlier stage.
In view of this emergency situation, the Court directed Himachal Pradesh on 7th June with prior notice to Haryana. Upper Yamuna River Board (UYRB) looks at how much water is coming into Hasnikund and then delivered to Wazirabad and Delhi
During hearing on June 3rd, Supreme Court had called upon UYRB for an emergent meeting scheduled for June 5th. Founded in 1995, UYRB has a major role in the management of shared waters between basin countries and monitoring projects related thereof including Okhla Barrage at Delhi. The main recipient states are Uttar Pradesh, Haryana, Rajasthan, Himachal Pradesh and National Capital Territory of Delhi.
