On Thursday, September 5, 2024, the Delhi High Court sought the stand of the CBI on the bail pleas of the co-owners of the Old Rajinder Nagar coaching centre basement in which three civil services aspirants on a drowning spree during July died, who are co-located in jail.
While Justice Dinesh Kumar Sharma issued notice to the agency on the bail applications of Parvinder Singh Tajinder Singh Harvinder Singh and Sarbjit Singh co‐owners of the basement, he also directed the agency to respond to it.
“Such an occurrence: this was quite regrettable-Matter in hand Justice Sharma has stated that the matter in hand should not be an ordinary matter,” said Justice Sharma.
The evidence advanced by the CBI in the regard of the essentiality of the accountability of basement co-owners was directed to the CBI counsel as “provide concrete evidence” and the father of one of the deceased aspirants was also allowed to submit a “short reply” concerning the bail pleas.
Shreya Yadav, aged 25 and from Uttar Pradesh, civil service aspirant Tanya Soni 25 from Telangana and Nevin Delvin 24 from Kerala are all deceased civil service aspirants and all three drowned in the basement of Rau’s IAS Study Circle due to floods on the evening of July 27.
Investigations into the matter, under the logic of the Bharatiya Nyaya Sanhita (BNS) including Tadi division, specifically section 105 (culpable homicide not amounting to murder), commenced looking into the case and the high course ordered it to be taken over from the Delhi Police by the CBI.
The Four owners have sought to plead that they only making the lease of the basement which was let out for rent to the coaching centre and hence are not responsible for that unfortunate incident.
A sessions court earlier rejected the bail applications moved by the accused, saying the probe by CBI is at an initial stage where the exact role of the accused persons has to be determined. The next hearing will be on September 11 and this will also be in public conferences.
