The Supreme Court on September 6, 2024 dismissed a petition filed by the former principal of R.G Kar Medical College and Hospital Sandip Ghosh, who raised objections against ‘the petitioner, the state and others’ representation regarding irregularities in the financial functioning of the institution during his term.
On 23, the High Court decided to shift the investigation in alleged financial irregularities to CBI, that was earlier inquired by a SIT constituted by the State.
‘As an accused Mr. Ghosh has no locus to impleaded in the plea,’ said a bench of Chief Justice D.Y. Chandrachud, Justices J.B. Pardiwala and Manoj Misra.
‘As an accused you have no locus to intervene in the PIL, where the Calcutta high court is monitoring the investigation,’ the Bench said.
The gruesome murder and reported sexual assault of a junior doctor in a similar setup at the State mad hospital was followed by movements all over the country.
The female doctor’s badly decomposed dead body with multiple wounds was discovered inside the seminar room of the chest department of the hospital on 9 August. The very next day a civic volunteer was picked up by Kolkata Police regarding the case.
The order dated August 23, 2022, of the High Court, was in response to a petition filed by the former deputy superintendent of the facility Akhtar Ali in which he sought an investigation by the Enforcement Directorate into the accusation of financial irregularities committed at the hospital when Ghosh was in charge.
The other reason because of which Mr. Ghosh had sought to be included as a party to the petition stands dismissed as the court held that Mr. Ghosh was not a ‘necessary party’ in the matter.
