A BMW car that had been damaged in a hit-and-run accident was parked at Worli police station, Mumbai, July 7, 2024. A lady died after the vehicle ran into the bicycle she was on with her husband.
On Wednesday (August 21, 2024), the Bombay High Court asked the police to respond to Mihir Shah and his driver Rajrishi Bidawat’s pleas requesting immediate release as they claimed that their arrests were “illegal”.
Shah was arrested two days after allegedly driving his BMW car into a motorbike in Worli area of Mumbai, killing Kaveri Nakhwa (45) and injuring Pradeep Nakhwa.
Bidawathis driver of Shah’s vehicle which had crashed on the day of alleged accidentwas taken into custody.
Both are currently in jail awaiting trial.
Their petitions for habeas corpus were filed last week in the high court by Shah and Bidawat, saying that their detention is illegal and must end immediately.
Before Justices Bharati Dangre and Manjusha Deshpande who sit over a division bench for all these cases (in question), arguments on both these applications were made yesterday (August 21, 2024).
The court ordered that the police file its reply affidavit and the hearing will be continued on August 29th.
In his plea, Shah requested for cancellation of orders passed by lower court firstly remanding him to police custody and thereafter to judicial custody.
