The Madhya Pradesh High Court has granted permission to abort a 14-year-old girl’s pregnancy who was allegedly kidnapped and raped a few months ago in the State’s Singrauli district.
Further, the court stated that the DNA tests should be conducted on the foetus.
In an order passed recently, Judge G.S. Ahluwalia said that the “doctors performing medical termination of pregnancy as well as the government of MP shall not be held responsible for this procedure and it shall be done only at the risk and cost of parents of prosecutrix (girl)”.
According to it, her parents can take her daughter to Chief Medical Health Officer (CMHO), District Hospital, Singrauli for this purpose.
“If CMHO feels necessary to send girl to any multispeciality hospital for better treatment then he may refer her to such hospital for undergoing MTP,” observed the court.
“Pregnancy at any gestational age can be terminated by a registered medical practitioner if foetus has substantial abnormalities and termination of pregnancy is approved by medical board,” said the court referring to report of DM Board Singrauli in its order.
The Investigating Agency is directed to preserve this fetus and immediately hand over it to them. It further adds that “the investigating officer is directed to send Foetus seized within two days from seizure thereof”to “DNA Fingerprint Laboratory”, says one statement from high court of Jabalpur dated June 30,2016
Sources say that earlier this year, she had gone missing and Morwa police station in the district lodged a case of kidnapping upon her disappearance.
She was found after more than a month and following which she underwent a medical examination which showed she was pregnant. Subsequently, police added rape charges against unknown person/s under Indian Penal Code (IPC) & POCSO Act-(Protection of Children from Sexual Offences Act).
Then father moved application before court seeking permission to terminate pregnancy.
