Punjab and Haryana were notified by Government of Chandigarh via a high court Friday notice that it has therefore promoted revolutionary sikh preachers amritpal singh so as to submit his Nomination papers for Lok Sabha seats from khadoor Sahib Assembly constituency in Punjab.
In a detailed response on Friday, the state government told the Punjab and Haryana High Court that Amrit Pal had filled up and signed two sets of nomination forms along with other documents on May 9th allowing him to proceed to Dibru Gal central met with his proposers while advocates were imprisoned then.
The state government informed the high court about this through an affidavit having been moved by Amritpal Singh to seek directions from the court to enable him spend seven days out of prison and submit his candidature papers for Khadoor Sahib Parliamentary seats. He also sought directions to facilitate him take some photographs and open a bank account for filing nomination papers.
Moreover, The Superintendent Of Central Jail at Dibrugarh shall administer oath upon the detainee (Amritpal) as per law including Candidate Handbook 2023 as well as issue oath receipt certificate and send original form to Punjab Khadoor Sahib for oath before Returning Officer.
On May 9, all necessary steps were taken, signatures photographed and relevant documents submitted to Deputy Superintendent of Dibrugarh central jail.
Thus, the petition filed by Amrit Pal as detailed above becomes meaningless due to public policy considerations made by the government in lieu of its arguments.
Amrit Pal who is currently lodged in Dibrugarh jail in Assam was arrested on April 23rd under National Security Act,1980. DM) passed another detention order under the National Security Act.
In his petition Amrit Pal stated that he had written a letter dated May 6, addressed Chief Election Commissioner (ECI) Chief Electoral Officer of Punjab requesting them arrange for required manner in which the petitioner could submit his nominations along with other necessary additional formalities as required by law. On May 7th, the ECI sent all necessary guidelines required in the case of the petitioner to the Chief Electoral Officer, Punjab and requested him to take necessary action in accordance with the said guidelines.
Then, based on this letter, Punjab CEO wrote to Deputy Commissioner and District Election Officer Tarn Taran requesting for further action and DM Amritsar wrote to Punjab government regarding whether the petitioner should be given means to contest election.
“Afterwards on May 8, Chief Electoral Officer, Punjab through a letter dated May 8 addressed Deputy Commissioner cum District Electoral Officer Tarn Taran seeking him to take such actions as directed and help out the people challenged Polling results disregarding above-mentioned directive .
In his petition he has asked for interim release for seven days under Section 15 of NSA so that he may present his nomination paper before Returning officer Khadoor Sahib for Lok Sabha poll. Last date of nomination is January14th5.
