Justice Bharati Dangre of the Bombay High Court on Tuesday August 27, 2024, abstained from hearing any orders or further proceedings in relation to the habeas corpus petition filed by the former mumbai police officer, sachin hindurao waze.
Earlier this month, on August 19 in an order in regard to a habeas corpus petition filed by one Mr Waze, who is currently a detainee under the Indian underworld and who leads the Nationalist Congress party, a Bench of Justices, Bharati Dangre and Manjusha Deshpande, after full drying the te litigated has propounded and issued.
It pertains to a case of corruption against some high profile politicians of India, one being currently the Union Minister for Home Affairs, Government of Maharashtra, and a leader of Nationalist Congress aegis Party Sharad Chandra Pawar, Mr Anil Deshmukh. The detention of the ex-police officer in that matter has since been challenged.
The averments and submissions in support of the plea were made and the bench had reserved the matter for ruling on August 27, 2021 but when the matter was called for ruling Justice Dangre did not hear the case for personal reasons. “I did not realize then that this matter also involved Anil Deshmukh.”
For personal reasons I would have to recuse myself in this case and even if someone asks for me to hear the pleadings related to this case, I cannot do so. I am not able to pass any order. I request that this case be not shown to me any further, Justice Darngre said. The appeal now will be taken before some other Division Bench for hearing.
As one of the points taken in the petition of Mr Waze he provides in this case, all the other accused are out of bail and it is only him who is further remanded despite being the approver in this case. In his bail application, he wants to appeal that while pursuing the allowance that the pardon granted by the special CBI court as more than towards months, he has spent a year and two months and has been in Taloja including this Central prison without a single charge.
Mr. Waze is the detained policeman who was also held in February 2021 after a Mahindra scorpio was discovered near industrialist Mukesh Ambani’s home, Antilia. The vehicle was found with 20 sticks of gelatin explosives and a note. The stolen vehicle was also identified as having a fake number plate while business Mansukhlal Hiren filed a theft FIR on the car.
Mr. Waze was then in charge of the investigation of the case and had called Mr. Hiren several times before he disappeared and was later found dead.
Mr. Hiren’s wife also lodged a complaint regarding Mr. Waze, the ex-police officer, which she believed was a deception.
The Handing Over of the Case to the NIA came after encouragement from the Maha Shashtra Terrorism Task Force. There were other co accused including Mr. Waze who had also been involved in some serious violations of the UAPA, sections 16, 18 and 20.
It is reported that it is in respect of the said Order that in compliance with the High Court’s directives, in April 2021, the CBI had registered an F.I.R. Against Mr. Deshmukh, Waze and other persons. It is stated in the petition that in the month of June in the year 2022 the CBI had made Mr. Waze an approver in the case, though under Section 306 of Cr PC.
Other witnesses also examined by other accused in the case of evidentiary value. Mr. Waze disputed the counter on the fact that his bail application is disturbed in view of the there being other witnessed to the case.
