Bombay High Court Removes Salman Khan’s Name from Anuj Thapan Custodial Death Petition
Anuj, one of the people accused of supplying weapons with regard to the shooting episode at Salman Khan’s house was found dead in a police lock-up toilet on May 1. Rita Devi, his mother, filed a petition before the high court on May 3 for foul play and investigation by CBI into the death.
Why Salman Khan’s name was removed by court
A division bench of Justices Revati Mohite-Dere and Shyam Chandak directed Ms. Devi on Friday to remove Salman Khan’s name from her petition. The judges said “there are no allegations against him”, adding that he is “not a necessary party” as far as concerns raised in the plea is concerned. They noted, “The relief has not been sought against him.” It was also stated that Ms. Devi has lost her son and hence the investigations will be conducted regarding such loss.
Argument by petitioner and court’s response
Counsel for Ms. Devi contended that even though no relief had been claimed by Mr. Khan yet he should have been roped in considering there is an ongoing CID probe. In their response, however, they reminded them CID makes its own decisions about persons interviewed during its investigations. In addition, they advised petitioner’s lawyer to concentrate on main matter being her son’s death without any other irrelevant issues.
Case Background
On April 14 two gunmen fired outside of Salman Khan residence and were later arrested while others escaped arrest until later dates when they were nabbed elsewhere including Thapan whose role was providing ammunition to those who performed this act of violence against Bollywood actor Salman Khan at his residence leading to many casualties He died in custody on May 1st amid allegations brought up by his mother concerning police brutality being among them.
Current status of case
The magistrate has been ordered by the court to issue fresh summons for recording her statement. A CID probe into his death is going on.
