The court cleared six men acquitted by the court of being accused with arson, rioting and robbery during communal Jan-Feb 2020 riots in northeast Delhi.
Additional Sessions Pulastya pramachala was presiding over their case. It was alleged that they ransacked a house at Shiv Vihar on February 25th, 2020. Additionally, this case has also been merged with a complaint about setting ablaze of a clinic.
A digital video recorder (DVR) was submitted as an evidence against the accused in this regard by the prosecution through an order passed on Friday by the court. “However, no witness is there to identify any of the accused persons in the videos,” it said.
It held that Investigating Officer (IO) of this case did not attempt to ascertain whether any of these accused appear in these video clips through some scientific examination or comparing those videos with specimen picture(s) of those persons who were accused.
However,” There is absolutely no evidence whatsoever before me which can establish that accused persons are appearing in those videos.”, it said.
“They have failed to prove that exact location of offenders was Karawal Nagar police station’s call details record (CDR) nor could they demonstrate involvement by them.” The Judge opined “I am of the opinion that there is no incriminating evidence against the accused persons;” he went on to say, “the charges levelled against the accused persons in this case are not proved at all.” This includes Hashim Ali, Abu Bakar, Mohammad Ajeej, Rashid Ali, Nazmuddin and Mohammad Danish who were all acquitted by it.
The matter had been registered at Karawal Nagar Police Station.
